Architectural Control Committee (ACC)

The legal authority and obligation of the SHHA to assure that deed restrictions are enforced is carried out by two Association committees. The Architectural Control Committee (ACC) manages the approval and monitoring of projects that change the external appearance of property such as construction and landscaping. The Covenant Support Committee (CSC) manages property use restrictions.

 

Covenant Support Committee

The SHHA Covenant Support Committee (CSC) is responsible to follow up on covenant complaints brought by homeowners of Sandia Heights. Upon receipt of written covenant complaints committee members visit complainants and alleged violators to discuss and observe alleged violations. It is not required nor suggested that the complainant contact the violator. If a violation of a covenant is established violators will receive a letter regarding non-compliance and have, in general 30 days from notification to remedy the violation. Violators are subject to legal action if they refuse to comply. Covenant support activities are performed by volunteers who devote a great deal of time and effort to helping preserve the unique character of Sandia Heights. Residents should view the receipt of a phone call, visit or letter regarding a covenant violation of a neighborly reminder based upon a sincere desire to preserve the beauty and property values within Sandia Heights.

RESOLVING PROBLEMS: SHHA property owner members that have complaints about suspected covenant violations in their Unit, or adjacent Unit in line of sight of a violation may file a written complaint as outlined below. It is the policy of the Covenant Support Committee to NOT divulge the name of the complainant filing this report to the alleged violator. However, should the violation be escalated to the stage of requiring court proceedings, the anonymity of the complainant can no longer be guaranteed. The SHHA will consider initiation of legal action for enforcement of the covenants, on behalf of a unit's property owners, based on the following criteria: severity of the violation, inability to clear up the violation by routine methods and procedures; availability of funds, and the potential for success.

PROCEDURES FOR FILING A COMPLAINT: Complaints regarding covenant violations must be submitted to the SHHA office. SHHA membership by the complainant is required for CSC action. A Covenant Support Committee member makes an on-site inspection to verify alleged violations of the deed restrictions. The SHHA will notify residents found to be in violation of any covenants by personal or letter contact. Compliance inspections are performed and follow up contacts are made on an as-needed basis.
